To notarize is the act by which the notary, who has public faith, attests that the signature on a document corresponds to that of the person who issued it.
It is a declaration by which the notary confirms the authenticity or similarity of the signature of a certain person on a document.
It is not referred to the content of the document, but only to the authenticity of the signature.
The modalities of signature recognition are: signature recognition for authenticity and signature recognition for similarity. In both cases, a signature card/signature form must be opened (see Business Setup).
What determines the type of recognition to be practiced is any legal requirement or the recipient of the document.
Signature witnessing is the act in which the user personally proves that he is a signatory of the document presented for the signature recognition.
The user must sign, in front of the notary public, the document that he/she intends to have the signature recognized as authentic. If the document is already signed, a new signature will be required on the document.
At the time of attendance, the attendee must sign, in addition to the document, a term on the proper book of the notary.
This term is proof of the affixing of the signature before the agent with public faith.
Acknowledgment of signature is performed by similarity when the notary certifies that the signature affixed to the document matches the signature deposited in its database. In other words, the recognition was made by comparing the signature contained deposited in the user’s standard form, without the need for his personal appearance for the act of signature recognition.
The recognition of a firm by similarity can be of economic value or of no economic value, according to the content or nature of the document.
In order for the notarization to be carried out, it is necessary that the person who signed the document has “signature form” in the notary’s office, which is done by opening a signature. It is important that the holder of the document knows the full name of the person who signed it. If the name is incomplete or wrong, or if it is a very repeated name, such as José da Silva, the person’s ID or CPF number is required, if this data is not included in the document, so that the search in the system can be done successfully and your record located.
For the notarization to be done, both signatures must be similar. The signature form has no expiration date, but the people change their signature over the years. In these cases, it is necessary for the person to go to the registry office again, to renew his/her signature.
Important: It is forbidden to notarize signatures in undated documents, with blank or incomplete spaces. Therefore, before attending the registry office, make sure that all the data contained in the document are completed and that it was not post-dated.
