What is it?

 

 

Notarial act is a public instrument in which the notary documents impartially, a fact, a situation or a circumstance witnessed by him/her, perpetuating it over time.

 

The notarial act has probative effectiveness, assuming that the facts therein are true. It is an important means of proof in the judicial sphere, as provided in article 384 of the Code of Civil Procedure (Law 13.105 / 2015). The notary acts can be used, for example, to check the existence and content of internet sites, WhatsApp conversations, meeting of legal entities, the state of real estate when handing over keys or attesting the presence of a person in a certain place or occurrence of any event.

 

The interested party may request the drawing up of the notarial act, as well as the performance of steps within the circumscription to which the notary belongs, to certify any fact.
