Emancipation

 

 

What is it?

 

Voluntary emancipation is the act in which the parents authorize the teenager, with the age between 16 and 18 years, to practice all the acts in the civil life, being apt to answer for these acts as if in a legal age.

 

 

 

 

What is the procedure?

 

The emancipation is made by a public deed, at the notary public office. It is an irrevocable act that makes the minor fully capable. It is mandatory for the father, mother and son to be emancipated, who must be over 16 (sixteen) years of age.

 

 

Required documents:

 

- Of the minor: birth certificate, ID, CPF (If he/she already has it);

- Of the parents ID and CPF.

 

 

Effects:

 

The deed of emancipation only has effects regarding to third parties after being registered with the civil Registry of Natural Persons in the district where the emancipated person resides (Article 89 of law 6.015 / 73 – Public Record Law)
